The Position
We are currently looking for a Legal Counsel to add to the Global Privacy Center of Expertise.
As Legal Counsel – Privacy EMEA, you will be responsible for PVH’s EU GDPR program, as well as the compliance program for other applicable privacy and data protection laws throughout the EMEA region. GDPR and related EMEA privacy law experience is essential to this role. The ideal candidate should be able to run a GDPR program, review and draft privacy policies, DPAs and DPIAs, as well as support customer services with data subject requests, all with significant independence. In short, we need you to help PVH to comply with all applicable regulation under these subject matters within EMEA, while navigating through an ever-evolving digital landscape and keeping the consumer at the center of what we do. You must also bring a commercial mindset and an ability to work quickly.
You will be working as part of a cross-functional team delivering best-in-class privacy and data protection counselling to business and functional teams, including supporting our expanding direct-to-consumer businesses, and assisting the Tommy Hilfiger Global/Calvin Klein Europe Go-to-Market team in respect of privacy components of consumer-facing initiatives. Your daily responsibility will be to offer consistent guidance on key areas, such as data governance, data retention and deletion, cross-border data transfers, processing register, trainings data security and privacy for consumers, our associates and B2B data.
The position will be resident at our PVH Europe campus in Amsterdam, the Netherlands. Our Legal team members there include over 20+ legal professionals of varying nationalities, backgrounds, cultures and legal expertise areas.
Key Responsibilities
- Running PVH Europe’s privacy and data protection program, including monitoring its compliance with GDPR and related EMEA region regulations, including those in the UK, Turkey and the UAE), as well as PVH’s privacy commitments as applied to its operations throughout EMEA.
- Improving existing privacy protocols, templates (DPA/DPIAs), policies, processes and procedures.
- Assisting and advising the EMEA Customer Service team with all privacy inquiries, concerns and complaints from data subject and supervisory authorities.
- Implementing global privacy guidelines developed within the Global Privacy COE.
- Developing further our data protection champion network and program in EMEA, including through trainings.
- Keeping Privacy Perfect register up to date.
- Creating a process and guidelines for data privacy impact assessment.
- Regular touch point with in-market Legal team members (Italy, UK, Germany and France) or local counsel on privacy matters.
- Updating and providing periodic reports to the VP, Associate General Counsel, Global Privacy on data protection risks and compliance issues.
- Advise and train business teams on compliance with GDPR, other regional regulations and the PVH Privacy commitment, and where necessary, ensure that data protection registrations and notification are complete and that the necessary safeguard for international data transfers are implemented.
- Advise and train Legal team members in-region on privacy clauses in agreements and review them, if necessary.
- Collaborating with the PVH Information Securities Group.
- Collaborating with the Legal Digital & Data team on guidelines and processes in relation to collection, storage and use of consumer data.
- Assess and resolve GDPR incidents in collaboration with VP, Associate General Counsel Global Privacy and relevant business partners.
- Ability to translate legal concepts, processes and instructions into simple language and improve the delivery of all messaging.
- Keen eye to improve all of the above and identify efficiencies.
- Ability to work in a close-knit team and support your colleagues.
The Ideal Candidate
- Bachelor’s and master’s law degree both obtained in Europe.
- 5+ years of experience gained in tech and privacy laws including GDPR gained through private practice or an in-house legal department (some in-house experience preferred).
- Track record of advising on privacy topics for large companies with an established online presence.
- Service-oriented, with ability to work and act as a true business counselor.
- Ability to work under pressure, juggle shifting priorities and handle multiple tasks simultaneously and independently.
- Well-organized and gives attention to detail.
- Commercial awareness and good negotiating skills.
- Result-oriented, efficient, decisive, and proactive.
- Fluency in written and spoken English is a must; any other language is a plus.
